Prediction Markets in Ohio
Status: contested. Last verified September 29, 2026.
Prediction markets such as Kalshi and Polymarket US are regulated federally by the Commodity Futures Trading Commission. Ohio's regulator treats sports event contracts as unlicensed sports betting, and in March 2025 it ordered Kalshi and two other companies to stop offering them in Ohio. Covers report
On September 25, 2026, the Sixth Circuit ruled for Ohio in KalshiEX LLC v. Schuler, holding that sports event contracts are not swaps under the Commodity Exchange Act and that states may enforce their gambling laws against them. The Ninth Circuit ruled the same way in a Nevada case, while the Third Circuit sided with Kalshi in New Jersey, so the Supreme Court may settle the question. Read the opinion
Prediction markets matter for matched betting because they do not limit winning traders. Check each app for current availability in Ohio before you deposit.

Online Casinos in Ohio
Online casinos are not legal in Ohio. The state's 11 casinos and racinos offer slots and table games in person only.
Sweepstakes casinos operate in Ohio under sweepstakes rules rather than a state license, so they offer fewer customer protections. Some of their sign-up offers are +EV. The Sweepstakes Casino Overview explains how they work.
Ohio lawmakers discussed online casino bills in 2026, including a proposal that would also ban sweepstakes casinos. None had passed as of September 29, 2026.

Offshore and unlicensed betting
Ohio law says no person may operate or conduct sports gaming in the state without a license from the Ohio Casino Control Commission (ORC 3775.03). Ohio's general gambling law also makes it a crime to engage in bookmaking, the business of receiving or paying off bets: a first-degree misdemeanor, or a fifth-degree felony for repeat offenders (ORC 2915.02). Advertising rules require affiliate marketers not to "advertise forms of illegal gambling or gaming in Ohio," and sports betting ads may run in Ohio only for licensed or applicant operators unless they say the offer is not available in Ohio (OAC 3775-16-08).
No Ohio statute specifically makes it a crime for a bettor to place a bet with an offshore or unlicensed site. The penalties in ORC 3775.99 that apply to bettors cover underage betting and insiders betting with their own sportsbook. The Commission has acted against offshore operators: in August 2024 it ordered Bovada to stop offering unlicensed gaming in Ohio, and Bovada left the state (Legal Sports Report).
