Prediction Markets in Wisconsin
Status: contested. Last verified October 2, 2026.
Prediction markets such as Kalshi and Polymarket US are regulated federally by the Commodity Futures Trading Commission. On April 23, 2026, the Wisconsin Department of Justice sued Kalshi, Robinhood, Coinbase, Polymarket and Crypto.com in Dane County. The state says their sports event contracts are commercial gambling under Wis. Stat. 945.03 and a public nuisance, and it asked the court to bar them from offering sports contracts to Wisconsin customers. Read the DOJ release
The CFTC then sued Wisconsin in federal court. In July 2026, Judge William Griesbach denied the CFTC's request for a preliminary injunction, finding that Wisconsin's gambling laws are not preempted by federal commodities law. Fox 11 report Elsewhere, the Sixth and Ninth Circuits have ruled for states, while the Third Circuit sided with Kalshi, so the Supreme Court may settle the question.
Prediction markets matter for matched betting because they do not limit winning traders. Check each app for current availability in Wisconsin before you deposit.

Offshore and unlicensed betting
Wisconsin's gambling law does not mention offshore or online sportsbooks by name, but it covers both sides of a bet. Under Wis. Stat. 945.02, anyone who makes a bet commits a Class B misdemeanor, unless the wager falls under an exception such as a tribal compact. The law draws no line between a bet placed in person and one placed online.
Running a betting operation is a Class I felony under Wis. Stat. 945.03. That includes taking bets for gain and using a wire communication facility to transmit bets or betting information on any sporting event. No published enforcement action against a named offshore sportsbook was found.
