Prediction Markets in West Virginia
Status: no state action found. Last verified October 2, 2026.
Prediction markets such as Kalshi and Polymarket US are regulated federally by the Commodity Futures Trading Commission. We found no cease-and-desist letter, lawsuit or court ruling involving prediction markets in West Virginia. West Virginia was also not among the 38 attorneys general who backed Massachusetts against Kalshi in April 2026. New York Attorney General release
Other states are fighting these apps in court. On September 25, 2026, the Sixth Circuit ruled for Ohio and Tennessee in KalshiEX LLC v. Schuler, and the Ninth Circuit ruled for Nevada, while the Third Circuit sided with Kalshi in New Jersey. None of those rulings binds West Virginia, which sits in the Fourth Circuit, so the Supreme Court may settle the question.
Prediction markets matter for matched betting because they do not limit winning traders. Check each app for current availability in West Virginia before you deposit.

Offshore and unlicensed betting
West Virginia law makes it a crime to run an unlicensed sportsbook or online casino. Under §29-22D-20, anyone other than a licensee who accepts, facilitates or operates a sports wagering operation commits a misdemeanor punishable by a fine of up to $10,000, up to 90 days in jail, or both. A third offense is a felony. §29-22E-20 sets the same penalties for unlicensed online casinos, and §29-22D-19 lets the Lottery Commission fine any person who violates the act up to $50,000 per violation. The statutes do not mention advertising.
No West Virginia statute specifically makes it a crime for a bettor to use an offshore or unlicensed site. The general gambling law, §61-10-5, makes betting on any game of chance a misdemeanor with a fine of $5 to $300, but it does not mention online or offshore betting. In June 2024 the West Virginia Lottery sent a cease-and-desist letter to Bovada, which then restricted West Virginia accounts. SBC Americas report
