Status: not challenged. Last verified October 2, 2026.
Prediction markets such as Kalshi and Polymarket US are regulated federally by the Commodity Futures Trading Commission. We found no cease-and-desist letter, lawsuit or court ruling involving the District's Office of Lottery and Gaming and these apps.
Elsewhere, courts are split. On September 25, 2026, the Sixth Circuit ruled for Ohio and Tennessee in KalshiEX LLC v. Schuler, and the Ninth Circuit ruled for Nevada, while the Third Circuit sided with Kalshi in New Jersey. The Supreme Court may settle the question. Read the Sixth Circuit opinion
Prediction markets matter for matched betting because they do not limit winning traders. Check each app for current availability in Washington, D.C. before you deposit.

Offshore and unlicensed betting
Washington, D.C. law bars anyone from taking part in sports wagering without a license. D.C. Code § 36-621.05(a)(1) says no individual or entity "may engage in an activity connected with sports wagering in the District of Columbia unless all the licenses required by this subchapter" have been obtained. Under § 36-621.04(c), the Attorney General can sue in Superior Court to stop a violation or seek a civil penalty of up to $50,000 per violation. § 36-621.05, § 36-621.04
The law does not mention offshore sportsbooks by name, and we found no provision that penalizes a bettor for placing a bet with an unlicensed site. In November 2020, the Office of Lottery and Gaming warned the public about unlicensed operators and recommended using only licensed books, but it did not name any. iGaming Business report
