Prediction Markets in Virginia
Status: available, not challenged by the state. Last verified October 2, 2026.
Prediction markets such as Kalshi and Polymarket US are regulated federally by the Commodity Futures Trading Commission. Virginia has not sent cease-and-desist letters to prediction market operators or sued them, and the Attorney General has not issued a public opinion on sports event contracts. CBS Sports summary
House Bill 271, filed in January 2026, would create a Virginia Gaming Commission and have it study prediction markets. It was carried over to the 2027 session. Gaming America report, SBC Americas report
Courts are split on whether states can regulate sports event contracts. The Sixth Circuit ruled for Ohio and Tennessee on September 25, 2026, and the Ninth Circuit ruled for Nevada, while the Third Circuit sided with Kalshi in New Jersey. Virginia sits in the Fourth Circuit, which has not decided the question. The Supreme Court may settle it.
Prediction markets matter for matched betting because they do not limit winning traders. Check each app for current availability in Virginia before you deposit.

Virginia Sports Betting Law and Timeline
- April 22, 2020: House Bill 896 and Senate Bill 384 became law as Chapters 1218 and 1256 of the 2020 Acts of Assembly, legalizing sports betting under the Virginia Lottery. The same law made it a civil violation to offer unpermitted online sports betting premises or advertise them. Code of Virginia, sports betting article
- July 1, 2020: The sports betting law took effect. Bettors must be 21, and credit cards cannot be used to fund betting accounts. Va. Code § 58.1-4040, Va. Code § 58.1-4031
- January 21, 2021: Online sports betting launched with FanDuel, regulated by the Virginia Lottery. Current licence holders are listed on the Lottery's casinos and sports betting page. WTKR report
- August 5, 2025: Attorney General Jason Miyares joined a bipartisan group of attorneys general asking the U.S. Department of Justice to act against illegal offshore gambling sites. Attorney General news release

Offshore and unlicensed betting
Virginia law covers unlicensed betting in two places. The sports betting law bars anyone without a Virginia Lottery permit from making premises available for online sports betting or advertising them for that purpose. The Lottery Director can fine violators up to $1,000 per day for each bettor and up to $10,000 per advertisement. Va. Code § 58.1-4042
The general gambling law defines illegal gambling as placing or receiving a bet in Virginia on any event, inside or outside the state. Placing such a bet is a Class 3 misdemeanor, and running an illegal gambling operation is a felony. The only sports betting exemption is for betting that is lawful under Virginia's sports betting law, so a bet with an unlicensed site is not covered by it. The statutes do not mention offshore or online sites by name, and no Virginia enforcement action against a named offshore sportsbook was found. § 18.2-325, § 18.2-326, § 18.2-328, § 18.2-334.3
