Is Sports Betting Legal in Utah?

Sports betting is not legal in Utah, online or in person. Utah's constitution bars the Legislature from authorizing any game of chance, and state law makes online gambling a crime. Prediction Markets in Utah

Status: contested, state cleared to enforce. Last verified October 2, 2026.

Prediction markets such as Kalshi and Polymarket US are regulated federally by the Commodity Futures Trading Commission. Utah treats sports event contracts as gambling, which its constitution bans. Governor Spencer Cox has said prediction markets are "gambling, full stop." Deseret News report

Kalshi sued Utah in February 2026. On August 4, 2026, U.S. District Judge Robert Shelby ruled for the state, finding that enforcing state gambling laws is not inconsistent with the CFTC's oversight. On September 8, 2026, the Tenth Circuit refused Kalshi's emergency request to block enforcement while its appeal is pending. KUER report, CDC Gaming Reports

Elsewhere, the Sixth Circuit ruled for Ohio and Tennessee on September 25, 2026, and the Ninth Circuit ruled for Nevada, while the Third Circuit sided with Kalshi in New Jersey, so the Supreme Court may settle the question.

Online casinos are not legal in Utah. The state constitution says the Legislature shall not authorize any game of chance, lottery or gift enterprise under any pretense or for any purpose. Utah Constitution, Article VI, Section 27

Utah law defines online gambling as gambling, fringe gambling or gaming by use of the internet or any mobile electronic device. Taking part in it is a misdemeanor, and offering it to someone in Utah is a third degree felony. Utah Code 76-9-1402, Utah Code 76-9-1404

Utah Sports Betting Law and Timeline

  • July 1, 2012: House Bill 108 took effect. It made clear that Utah's gambling ban covers any form of internet gambling and made transmitting or relaying internet gambling into the state a crime. House Bill 108 (2012), enrolled

  • February 2026: Kalshi sued Governor Spencer Cox, Attorney General Derek Brown and other state officials in federal court in Utah, arguing that federal commodities law blocks Utah from enforcing its gambling laws against it. Covers report

Offshore and unlicensed betting

Utah law bans online gambling outright, including bets placed with sites based outside the state. It defines online gambling as gambling, fringe gambling or gaming by use of the internet or any mobile electronic device. Participating in online gambling is a class B misdemeanor, or a class A misdemeanor for a repeat offense. Utah Code 76-9-1402

Intentionally providing or offering online gambling to anyone in Utah is a third degree felony. Internet service providers, hosting companies, telecommunications providers and internet advertising services are exempt when they only transmit or store material they did not select. Utah Code 76-9-1404
