Prediction Markets in Tennessee
Status: contested. Last verified October 2, 2026.
Prediction markets such as Kalshi and Polymarket US are regulated federally by the Commodity Futures Trading Commission. Tennessee's Sports Wagering Council treats sports event contracts as unlicensed sports betting. On January 9, 2026, it ordered Kalshi, Polymarket and Crypto.com to stop offering them in Tennessee, void open contracts and refund deposits. Covers report
Kalshi sued, and in February 2026 a federal judge in Nashville blocked the state from enforcing its law against the company. On September 25, 2026, the Sixth Circuit vacated that injunction, holding that sports event contracts are not swaps and that states may enforce their gambling laws against them. The Ninth Circuit ruled the same way in a Nevada case, while the Third Circuit sided with Kalshi in New Jersey, so the Supreme Court may settle the question. Read the opinion
Prediction markets matter for matched betting because they do not limit winning traders. Check each app for current availability in Tennessee before you deposit.

Online Casinos in Tennessee
Online casinos are not legal in Tennessee, and the state has no commercial casinos. Legal gambling options are online sports betting, daily fantasy sports and the state lottery.
Sweepstakes casinos are also off the table. In May 2026, Governor Bill Lee signed Senate Bill 2136, which bans online games that use a virtual-currency or dual-currency system to imitate slots, table games, video poker, bingo or unlicensed sports wagering. The Attorney General enforces it under the Tennessee Consumer Protection Act. Covers report

Offshore and unlicensed betting
Tennessee law reaches offshore sportsbooks through the Sports Gaming Act. Tenn. Code Ann. § 4-49-127 lets the Sports Wagering Council investigate anyone accepting wagers without a license and requires it to fine them $10,000 for a first offense, $15,000 for a second and $25,000 for each later offense. The criminal code also makes gambling promotion a Class B misdemeanor and aggravated gambling promotion (running a gambling enterprise) a Class E felony. Neither criminal section mentions online or offshore betting by name. The Council has used its powers against named offshore books, including Bovada in 2024, five more in July 2025 and three in August 2026.
For bettors, Tenn. Code Ann. § 39-17-502 makes knowingly gambling a Class C misdemeanor, and § 39-17-501 exempts only wagers placed "in accordance with the Tennessee Sports Gaming Act". The statute does not name offshore sites, but the Council's FAQ states that it is illegal to place a bet with an online sportsbook not licensed by Tennessee. No penalty specific to offshore bettors is written into the law.
