Schuler, and the Ninth Circuit ruled for Nevada, while the Third Circuit sided with Kalshi in New Jersey. Those rulings do not bind South Dakota, but the Supreme Court may settle the question. Sixth Circuit opinion
Prediction markets matter for matched betting because they do not limit winning traders. Check each app for current availability in South Dakota before you deposit.

Offshore and unlicensed betting
South Dakota's Internet gambling law makes it a felony for a person engaged in a gambling business to use the internet to take bets or wagers, or to set up a site in the state to run an internet gambling business. A first offense is a Class 6 felony and a repeat offense is a Class 5 felony. A violation occurs if the bet starts or ends in South Dakota, and each bet counts as a separate violation. The attorney general may notify a gambling business that its website is illegal in the state. Licensees of the Commission on Gaming and the state lottery are exempt. SDCL 22-25A-7, SDCL 22-25A-10, SDCL 22-25A-12
That chapter targets gambling businesses, not bettors. For bettors, the general gambling law makes it a Class 2 misdemeanor for any person to place or accept a wager on a sporting event, except at licensed Deadwood gaming operations. It does not mention online or offshore sites by name. In August 2025 the Commission on Gaming warned that online platforms offering sports wagering are not authorized in South Dakota, but it did not name specific sites. SDCL 22-25-1, Commission on Gaming alert
