Prediction Markets in South Carolina
Status: not blocked by the state, private lawsuit pending. Last verified October 2, 2026.
Prediction markets such as Kalshi and Polymarket US are regulated federally by the Commodity Futures Trading Commission. South Carolina has no sports betting regulator, and we found no cease-and-desist letter or state lawsuit against a prediction market in South Carolina.
On July 30, 2026, a retired attorney sued Polymarket, DraftKings Predictions and several exchanges and market makers in Charleston County. He argues their sports event contracts are illegal betting under South Carolina law and seeks to recover losses under a gambling-loss recovery statute, Section 32-1-10. Kalshi is not a defendant. Courthouse News report
Federal courts are split on whether states can regulate these contracts. The Sixth Circuit (Ohio and Tennessee) and the Ninth Circuit (Nevada) sided with states, while the Third Circuit sided with Kalshi in New Jersey.
Prediction markets matter for matched betting because they do not limit winning traders. Check each app for current availability in South Carolina before you deposit.

Offshore and unlicensed betting
South Carolina law does not mention online or offshore sports betting. The general ban is Section 16-19-130, which makes bookmaking, pool selling, recording bets on any contest of skill, speed or endurance, and receiving or forwarding money bet a misdemeanor, with a fine of up to $1,000, up to six months in jail, or both. It also covers anyone who aids those acts. Section 16-19-40 separately punishes playing at a gaming house with up to 30 days in jail or a fine of up to $100.
Neither section names internet or offshore sportsbooks, and the gambling chapter has no rule on advertising. Under Section 32-1-10, a person who loses $50 or more gambling may sue the winner to recover it within three months. We found no state enforcement action against a named offshore sportsbook.
