Prediction markets such as Kalshi and Polymarket US are regulated federally by the Commodity Futures Trading Commission. Rhode Island law lets only the state, through the Rhode Island Lottery, offer sports wagering. On May 21, 2026, Attorney General Peter Neronha sued Kalshi and Polymarket in state court, saying their sports contracts are illegal gambling. The state case was moved to federal court, and on May 28, 2026, the United States and the CFTC asked to join Kalshi's case to argue that federal law overrides Rhode Island's gambling laws. As of October 2, 2026, we found no ruling on Kalshi's request for a preliminary injunction. Read the CFTC filing
Federal appeals courts are split. On September 25, 2026, the Sixth Circuit ruled for Ohio and Tennessee in KalshiEX LLC v. Schuler. The Ninth Circuit ruled for Nevada, while the Third Circuit sided with Kalshi in New Jersey, so the Supreme Court may settle the question. Read the Sixth Circuit opinion
