Prediction Markets in Pennsylvania
Status: available. Last verified October 2, 2026.
Prediction markets such as Kalshi and Polymarket US are regulated federally by the Commodity Futures Trading Commission. Pennsylvania has not sued them or sent them cease-and-desist letters. The Pennsylvania Gaming Control Board opposes them: in an April 30, 2026 letter to the CFTC, it said a contract on the outcome of a sporting event is sports wagering and noted that these apps accept 18-year-olds, while Pennsylvania sportsbooks require bettors to be 21. Read the letter
Pennsylvania is in the Third Circuit, which ruled for Kalshi in a New Jersey case on April 6, 2026. The Sixth Circuit (Ohio and Tennessee) and Ninth Circuit (Nevada) ruled the other way, so the Supreme Court may settle the question. Third Circuit opinion
In July 2026, Representative Tarik Khan introduced House Bill 2711, which would regulate prediction markets in Pennsylvania with a minimum age of 21 and self-exclusion rules. It was referred to the House Consumer Protection, Technology and Utilities Committee. Covers report
Prediction markets matter for matched betting because they do not limit winning traders. Check each app for current availability in Pennsylvania before you deposit.

Sweepstakes casinos are not licensed by the Board. In April 2025, the Board's enforcement counsel told lawmakers it considers them illegal online gambling and had sent 18 cease-and-desist letters to sweepstakes operators. Covers report The Sweepstakes Casino Overview explains how they work.

Offshore and unlicensed betting
Pennsylvania law explicitly makes unlicensed sports betting a crime. Under 4 Pa.C.S. § 13C04, added by Act 42 of 2017, it is unlawful to offer sports wagering or accept a sports bet from anyone physically located in Pennsylvania without a Gaming Control Board certificate, or to knowingly provide services to such an operation. A first offense is a first-degree misdemeanor with a fine of up to $150,000 for an individual. A repeat offense is a second-degree felony. A separate rule, 4 Pa.C.S. § 1518(a)(3.1), makes it a felony for an unlicensed operator to accept online casino wagers without verifying a player's age, identity and location.
The law does not make placing a bet with an offshore site a separate crime for the bettor. It does say that a person who engages in sports wagering from a location where sports wagering is unauthorized forfeits all winnings to the state's problem gambling fund. The Board sent offshore sportsbook Bovada a cease-and-desist letter in August 2024 (Bonus.com report), and in September 2025 it warned bettors that offshore sites offer no player protections (PGCB press release).
