Status: available, not challenged by the state. Last verified October 2, 2026.
Prediction markets such as Kalshi and Polymarket US are regulated federally by the Commodity Futures Trading Commission. We found no cease-and-desist letter or lawsuit from Oregon's government against them.
In February 2026, Oregon bettors filed a private class action against Kalshi, arguing its sports event contracts are unlicensed gambling under Oregon law. Case summary
Oregon is in the Ninth Circuit, which ruled for Nevada in its case against Kalshi. The Sixth Circuit ruled the same way for Ohio and Tennessee on September 25, 2026, while the Third Circuit sided with Kalshi in New Jersey, so the Supreme Court may settle the question.
Prediction markets matter for matched betting because they do not limit winning traders. Check each app for current availability in Oregon before you deposit.

Offshore and unlicensed betting
Oregon law makes it a crime for a bettor to place a bet with a bookmaker or to take part in unlawful gambling as a player. This is unlawful gambling in the second degree, a Class A misdemeanor under ORS 167.122. Promoting or profiting from unlawful gambling is a Class C felony under ORS 167.127. ORS chapter 167
ORS 167.109 targets online operators directly: an Internet gambling business may not accept credit cards, bank transfers, checks or other payments for unlawful online gambling (Class C felony). The statutes do not name offshore sites, and we found no Oregon enforcement action against a named offshore sportsbook. In 2025 the Attorney General advised that private online sportsbooks and casinos offer gambling under Oregon law. Attorney General Opinion 8297
