Prediction Markets in North Carolina
Status: legal. Last verified October 2, 2026.
Prediction markets such as Kalshi and Polymarket US are regulated federally by the Commodity Futures Trading Commission. North Carolina has not sued or sent cease-and-desist orders to prediction markets. Instead, the 2026 state budget, signed on July 7, 2026, recognizes that CFTC-registered prediction markets may operate in the state and taxes them at 6% of net trading fee revenue from January 1, 2027. Senate Bill 257, Fiscal note
The law does not require prediction markets to hold a state license. This differs from Ohio and Tennessee, where the Sixth Circuit ruled on September 25, 2026, that states may enforce their gambling laws against sports event contracts. A separate bill to ban prediction markets, House Bill 1171, has sat in committee since May 2026. House Bill 1171
Prediction markets matter for matched betting because they do not limit winning traders. Check each app for current availability in North Carolina before you deposit.

Offshore and unlicensed betting
North Carolina law makes it a crime to offer or place a sports bet outside the licensed system. Under G.S. 18C-918(a), added by House Bill 347 in 2023, "any person who knowingly offers or engages in sports wagering in violation of this Article" is guilty of a Class 2 misdemeanor. The wording covers both operators and bettors. The statute does not mention offshore sites by name. The state's general gambling ban, G.S. 14-292, also makes betting on a game of chance a Class 2 misdemeanor unless another law allows it.
The North Carolina State Lottery Commission states that "it is illegal to place a wager with an online operator that is not licensed by the state of North Carolina." Commission player FAQ. We found no published cease-and-desist letters from the Commission against named offshore sportsbooks.
