Prediction Markets in New Mexico
Status: contested. Last verified October 2, 2026.
Prediction markets such as Kalshi and Polymarket US are regulated federally by the Commodity Futures Trading Commission. New Mexico's Attorney General says Kalshi's sports event contracts are unlicensed sports betting. On June 4, 2026, he sued Kalshi in state court, also alleging it lets 18 to 20 year olds trade even though New Mexico's minimum gaming age is 21. Read the press release
On June 12, 2026, the CFTC sued New Mexico, arguing that federal law gives it exclusive authority over these contracts. Separately, four tribal nations asked a federal judge in New Mexico to block Kalshi, and that request was still pending as of October 2, 2026. CFTC press release, Source NM report
Other federal appeals courts are split: the Sixth and Ninth Circuits ruled for the states, while the Third Circuit sided with Kalshi, so the Supreme Court may settle the question.
Prediction markets matter for matched betting because they do not limit winning traders. Check each app for current availability in New Mexico before you deposit.

Online Casinos in New Mexico
Online casinos are not legal in New Mexico. Casino games are offered in person at tribal casinos and at racetrack casinos. The New Mexico Gaming Control Board oversees tribal gaming compacts, racetrack casinos, non-profit gaming and bingo, and does not license any online casino.
Sweepstakes casinos run under sweepstakes rules rather than a state license, so they offer fewer customer protections. The Sweepstakes Casino Overview explains how they work.
