Prediction Markets in New Jersey
Status: contested. Last verified October 2, 2026.
Prediction markets such as Kalshi and Polymarket US are regulated federally by the Commodity Futures Trading Commission. New Jersey’s Division of Gaming Enforcement treats sports event contracts as unlicensed sports betting, and on March 27, 2025, it ordered Kalshi to stop offering them to New Jersey residents. Kalshi sued, and on April 28, 2025, a federal judge blocked the state from enforcing its gambling laws against Kalshi’s sports contracts. Read the district court opinion
On April 6, 2026, the Third Circuit upheld that order in KalshiEX LLC v. Flaherty. The 2 to 1 panel held that Kalshi’s sports contracts are likely swaps under the Commodity Exchange Act, so federal law likely overrides New Jersey’s gambling laws. The ruling came at the preliminary injunction stage, not after a full trial. Read the opinion
The Sixth Circuit (Ohio and Tennessee) and the Ninth Circuit (Nevada) ruled the other way. New Jersey filed a petition asking the Supreme Court to hear the case on September 2, 2026, and Kalshi’s response is due November 9, 2026. Supreme Court docket
Prediction markets matter for matched betting because they do not limit winning traders. Check each app for current availability in New Jersey before you deposit.

Offshore and unlicensed betting
Since August 15, 2025, New Jersey’s criminal code covers online gambling directly. P.L.2025, c.128 added N.J.S.2C:37-4(c), which makes it a third-degree crime to operate or maintain a gambling website or app that accepts bets from people in New Jersey unless it is regulated by the state. The fine is $50,000 to $100,000. The same law amended the promoting gambling offense (N.J.S.2C:37-2) to include gambling that happens online unless the state regulates it.
The law targets operators and promoters, not bettors. Under N.J.S.2C:37-2(c), taking part “only as a player” is a defense to a promoting gambling charge, and no section sets a penalty for simply placing a bet with an unlicensed site. Offshore sites are still unlicensed, so New Jersey regulators cannot help you if a site refuses to pay. In February 2019, the Division of Gaming Enforcement ordered the affiliate site OddsShark to stop promoting offshore sportsbooks and told licensed operators to stop working with it. BettingUSA report
