Status: blocked. Last verified October 2, 2026.
Prediction markets such as Kalshi and Polymarket US are regulated federally by the Commodity Futures Trading Commission. Nevada's Gaming Control Board treats sports, election and entertainment event contracts as unlicensed wagering. Since 2025 it has sent cease-and-desist letters to Kalshi and Crypto.com, warned Robinhood, and won state court orders against Kalshi, Coinbase and Polymarket. Board timeline
In July 2026 Kalshi agreed to geofence Nevada by August 12, 2026. On August 28, 2026, the Ninth Circuit ruled for Nevada in KalshiEX, LLC v. Assad, holding that sports event contracts are likely not swaps and that Nevada may enforce its gaming laws against them. It sent the election contract question back to the district court. The Sixth Circuit ruled the same way for Ohio, while the Third Circuit sided with Kalshi in New Jersey, so the Supreme Court may settle the question. Read the opinion
