Prediction Markets in Nebraska
Status: no state enforcement found. Last verified October 2, 2026.
Prediction markets such as Kalshi and Polymarket US are regulated federally by the Commodity Futures Trading Commission. We found no cease-and-desist letter or lawsuit by Nebraska regulators against a prediction market.
Nebraska has backed other states in court. It joined a multistate brief in the Massachusetts case against Kalshi in April 2026 (New York Attorney General release), and another supporting Ohio and Tennessee at the Sixth Circuit in June 2026 (California Attorney General release). On September 25, 2026, the Sixth Circuit ruled for Ohio and Tennessee. The Ninth Circuit ruled the same way in a Nevada case, while the Third Circuit sided with Kalshi in New Jersey, so the Supreme Court may settle the question.
Prediction markets matter for matched betting because they do not limit winning traders. Check each app for current availability in Nebraska before you deposit.
