Prediction Markets in Montana
Status: contested. Last verified October 2, 2026.
Prediction markets such as Kalshi and Polymarket US are regulated federally by the Commodity Futures Trading Commission. Montana's Gambling Control Division says Kalshi's event contracts are illegal gambling and illegal sports wagering under state law. It sent Kalshi cease-and-desist letters on March 26, 2025, and April 6, 2026. Read the 2025 letter
Kalshi sued Montana officials in federal court in April 2026. On September 17, 2026, both sides asked the court to dismiss the case. Under the stipulation, Montana officials will not enforce against Kalshi until the Ninth Circuit resolves Kalshi's rehearing petition in KalshiEX v. Assad, the Nevada case decided August 28, 2026, and must give 30 days' written notice before acting. Read the stipulation
Montana is in the Ninth Circuit, which ruled for Nevada against Kalshi, so Kalshi's position in Montana may change quickly. Prediction markets matter for matched betting because they do not limit winning traders. Check each app for current availability in Montana before you deposit.

Offshore and unlicensed betting
Montana law explicitly targets offshore operators. Section 23-5-162, MCA, says a person who knowingly operates "any type of illegal internet gambling site within the state's borders, including operating an online gambling site in the state through licensed or unlicensed offshore sources," faces felony liability: a fine of up to $50,000, up to 10 years in prison, or both. Advertising for or soliciting people to join an illegal gambling enterprise is also a crime under Section 23-5-154. Section 23-5-162, MCA, Section 23-5-154, MCA
We found no Montana statute that names a separate offence for a bettor who places a wager with an offshore site. The law is general: "Except as specifically authorized by statute, all forms of public gambling, lotteries, and gift enterprises are prohibited," and sports wagering is only lawful through the state lottery. Section 23-5-151, MCA, Section 23-7-104, MCA
