Prediction Markets in Maryland
Status: contested. Last verified October 2, 2026.
Prediction markets such as Kalshi and Polymarket US are regulated federally by the Commodity Futures Trading Commission. Maryland's regulator treats sports event contracts as unlicensed sports betting, and on April 7, 2025, it ordered Kalshi, Robinhood and Crypto.com to stop offering them in Maryland. Letter to Kalshi
Kalshi sued Maryland in KalshiEX LLC v. Martin. On August 1, 2025, a federal judge refused to block the state's gambling laws, and Kalshi appealed to the Fourth Circuit. Maryland has agreed not to enforce its laws against Kalshi until the appeal is decided, and the appeal was still pending as of September 25, 2026. Sixth Circuit opinion
Other appeals courts are split. The Sixth Circuit ruled for Ohio and Tennessee on September 25, 2026, and the Ninth Circuit ruled for Nevada, while the Third Circuit sided with Kalshi in New Jersey, so the Supreme Court may settle the question.
Prediction markets matter for matched betting because they do not limit winning traders. Check each app for current availability in Maryland before you deposit.

Online Casinos in Maryland
Online casinos are not legal in Maryland. Maryland Lottery and Gaming says licensed sportsbooks and registered fantasy contests are the only legal online gaming options in the state. Maryland Lottery and Gaming
Sweepstakes casinos are also available to some Maryland players, but the regulator treats them as illegal and has sent cease-and-desist letters to operators including Stake.us, McLuck and VGW (Chumba Casino, LuckyLand Slots). They offer fewer customer protections than licensed sites. The Sweepstakes Casino Overview explains how they work.
In 2026 the House passed bills to ban sweepstakes casinos (HB 295 and SB 112), but the Senate did not vote on them before the session ended. A bill to put online casinos to a referendum (SB 761) was withdrawn in March 2026. None had passed as of October 2, 2026.

Offshore and unlicensed betting
Maryland has no law that names offshore or online sportsbooks. Its general gambling laws apply instead. Making a book or pool, or receiving or forwarding money to be bet on a contest, is a misdemeanor punishable by up to 6 months in jail, a $5,000 fine, or both. Criminal Law § 12-102. Betting for money is itself a civil offense with a fine of up to $500, or $1,000 if more than $100 is involved, and it does not count as a criminal conviction. Criminal Law § 12-103. Neither section mentions online or offshore betting, and only licensed operators may offer sports wagering under State Government § 9-1E-03.
Maryland Lottery and Gaming has sent cease-and-desist letters to offshore sportsbooks including BetUS, BetNow, Everygame, BetAnySports and Bookmaker.eu, and lists them on its Legal vs. Illegal Online Gaming page. A 2026 bill that would have made it a crime to operate or promote unlicensed online casino games (HB 295) passed the House but did not get a Senate vote.
