Prediction Markets in Massachusetts
Status: contested. Last verified October 2, 2026.
Prediction markets such as Kalshi and Polymarket US are regulated federally by the Commodity Futures Trading Commission. Massachusetts treats sports event contracts as unlicensed sports wagering. In September 2025, Attorney General Andrea Joy Campbell sued Kalshi in Suffolk Superior Court, and on January 20, 2026, the court granted a preliminary injunction barring Kalshi from offering sports contracts in the state without a license. Attorney General announcement
The injunction has not taken effect. In February 2026, a Massachusetts Appeals Court justice stayed it while Kalshi appeals. The Supreme Judicial Court took the case and heard arguments on May 4, 2026, and it had not ruled as of October 2, 2026. Polymarket US and Robinhood have filed their own federal lawsuits against the state, and the Polymarket case is paused until the Kalshi appeal is decided. Bloomberg Law report
Elsewhere, the Sixth and Ninth Circuits have ruled for states, while the Third Circuit sided with Kalshi in New Jersey, so the Supreme Court may settle the question.
Prediction markets matter for matched betting because they do not limit winning traders. Check each app for current availability in Massachusetts before you deposit.

Online Casinos in Massachusetts
Online casinos are not legal in Massachusetts. The state's two resort casinos and one slots parlor offer gaming in person only.
Sweepstakes casinos operate in Massachusetts under sweepstakes rules rather than a state license, so they offer fewer customer protections. Some of their sign-up offers are +EV. The Sweepstakes Casino Overview explains how they work.
A 2025 House bill, H.4431, would have legalized online casinos and prohibited unlicensed sweepstakes. On March 23, 2026, it was sent to a study order, which ends its chances this session. No online casino bill had passed as of October 2, 2026.

Offshore and unlicensed betting
Massachusetts law makes running an unlicensed sportsbook a crime. G.L. c. 23N, section 5 bars anyone from engaging in sports wagering activity without the required licenses. Under G.L. c. 23N, section 21, anyone other than a licensed operator who "engages in accepting, facilitating or operating a sports wagering operation" faces up to 90 days in jail or a $10,000 fine for a first offense, rising to 1 to 9 years in state prison for a third. The Gaming Commission can also fine any person up to $2,000 per violation. G.L. c. 271, section 17A, rewritten by the 2022 sports wagering law, makes it a crime, except as permitted under chapter 23N, to use a telephone, the internet or other communications technology to accept bets, or to place "all or any portion of a wager with another," on an athletic game. The penalty is a fine of up to $2,000 or up to 1 year in jail.
The Attorney General's Office has acted against named offshore books. It sent a cease-and-desist letter to Bovada on October 3, 2024, and to BetOnline.ag and Sportsbetting.ag on June 25, 2025, ordering each to stop serving Massachusetts and refund Massachusetts users.
