Prediction Markets in Kansas
Status: available, not challenged. Last verified October 2, 2026.
Prediction markets such as Kalshi and Polymarket US are regulated federally by the Commodity Futures Trading Commission. Kansas has not sent cease-and-desist letters to prediction market companies, and we found no lawsuit between Kalshi and Kansas. In April 2025 the Kansas Racing and Gaming Commission's enforcement attorney said it was not planning to send such letters and would watch the court cases and the CFTC first. Courts elsewhere are split. The Sixth Circuit ruled for Ohio and Tennessee on September 25, 2026, and the Ninth Circuit ruled for Nevada, while the Third Circuit sided with Kalshi in New Jersey. Sixth Circuit opinion
Prediction markets matter for matched betting because they do not limit winning traders. Check each app for current availability in Kansas before you deposit.

Offshore and unlicensed betting
Kansas law does not name offshore or online sportsbooks. Its general gambling law makes "making a bet" a class B nonperson misdemeanor (K.S.A. 21-6404). The definition of a bet excludes sports wagering under the Kansas Expanded Lottery Act (K.S.A. 21-6403), and that act covers only bets placed at or through a Kansas lottery gaming facility, including its online platform (K.S.A. 74-8702). The statutes do not mention the internet or offshore sites.
Receiving bets as a business is commercial gambling, a severity level 8 nonperson felony (K.S.A. 21-6406), and so is setting up communication facilities used mainly to transmit betting information (K.S.A. 21-6409). The 2022 sports wagering law did not add a specific crime for unlicensed sportsbooks or for advertising them. The Kansas Racing and Gaming Commission sent Bovada a cease-and-desist notice on July 8, 2024, and Bovada stopped serving Kansas (SBC Americas).
