Status: contested. Last verified October 2, 2026.
Prediction markets such as Kalshi and Polymarket US are regulated federally by the Commodity Futures Trading Commission. On September 9, 2026, Judge Stephen Locher denied Kalshi's request for a preliminary injunction in KalshiEX LLC v. Bird, finding Kalshi unlikely to show that federal law blocks Iowa's gambling laws. Kalshi has appealed to the Eighth Circuit. Court docket, SBC Americas summary
Courts elsewhere are split. The Sixth Circuit ruled for Ohio and Tennessee on September 25, 2026, and the Ninth Circuit ruled for Nevada, while the Third Circuit sided with Kalshi in New Jersey. Sixth Circuit opinion
Iowa lawmakers also considered licensing and taxing prediction markets in 2026. The Senate passed Senate File 2470, but it stalled in a House committee. Iowa Legislature bill page, Gazette report

Offshore and unlicensed betting
Iowa law does not name offshore sportsbooks. Its general gambling law, Iowa Code section 725.7, bans making any bet or engaging in bookmaking unless state law allows it. Penalties start at a serious misdemeanor and rise with the amount involved and repeat offences. The statute does not mention online or offshore betting.
Since July 1, 2026, Senate File 2289 lets the Iowa Racing and Gaming Commission issue cease-and-desist orders and seek court injunctions against anyone offering sports wagering or other gambling in Iowa without a licence. We found no public order against a named offshore sportsbook as of October 2, 2026. Only operators on the Commission's licensing page may take sports bets in Iowa.
