Prediction Markets in Indiana
Status: available. Last verified October 2, 2026.
Prediction markets such as Kalshi and Polymarket US are regulated federally by the Commodity Futures Trading Commission. Indiana has not sent cease-and-desist letters to prediction market operators, has not sued them, and has not passed a law about them. In May 2026, Indiana Gaming Commission officials said prediction markets fall under federal jurisdiction and the Commission has no oversight authority over them. Indiana Capital Chronicle report
Courts elsewhere are split. On September 25, 2026, the Sixth Circuit ruled for Ohio and Tennessee in KalshiEX LLC v. Schuler, and the Ninth Circuit ruled for Nevada, while the Third Circuit sided with Kalshi in New Jersey. Indiana is not part of those cases, but the Supreme Court may settle the question for every state. Sixth Circuit opinion
Prediction markets matter for matched betting because they do not limit winning traders. Check each app for current availability in Indiana before you deposit.

Offshore and unlicensed betting
Indiana law covers offshore and unlicensed online betting in two ways. Under IC 35-45-5-2, any person who knowingly gambles commits unlawful gambling, a Class B misdemeanor. An operator who knowingly uses the Internet to run unlawful gambling in Indiana, or with a person located in Indiana, commits a Level 6 felony. IC 35-45-5-3(b) makes Internet bookmaking or accepting bets from a person in Indiana professional gambling over the Internet, also a Level 6 felony. These offences do not apply to sports wagering licensed under IC 4-38 (IC 35-45-5-14). Indiana Code Title 35
The bettor offence is the general unlawful gambling ban; it does not mention offshore sites by name. We found no Indiana cease-and-desist letters or blocking orders against named offshore sportsbooks. In March 2025, the Attorney General and the Gaming Commission warned the public about an unnamed illegal gambling website advertising on Facebook. State consumer alert
