Prediction Markets in Hawaii
Status: available. Last verified October 2, 2026.
Prediction markets such as Kalshi and Polymarket US are regulated federally by the Commodity Futures Trading Commission. Both operate in Hawaii, and we found no cease-and-desist letter, lawsuit or court ruling involving Hawaii. Civil Beat report
In the 2026 session, the House passed House Bill 2198. It would expressly add event contracts on sports, politics, elections, catastrophes and other topics to Hawaii's definition of gambling. The bill stalled in the Senate without a hearing, and its sponsor plans to bring it back. House committee report
Federal courts are split on whether states can regulate these contracts. The Sixth and Ninth Circuits ruled for states, while the Third Circuit sided with Kalshi, so the Supreme Court may settle the question.
Prediction markets matter for matched betting because they do not limit winning traders. Check each app for current availability in Hawaii before you deposit.

Offshore and unlicensed betting
Hawaii law does not mention online or offshore betting by name, but it bans gambling in general and makes no exception for websites. Under HRS 712-1223, a person who knowingly participates in any gambling activity commits a misdemeanor. That covers bettors as well as operators. Taking bets is a felony: HRS 712-1221 makes bookmaking of more than five bets totaling more than $500 in seven days a class B felony, and HRS 712-1222 makes other promoting of gambling a class C felony.
We found no Hawaii enforcement action against a named offshore sportsbook. The closest example is the Honolulu Prosecuting Attorney's 2016 cease-and-desist demand to DraftKings and FanDuel over daily fantasy sports.
