Prediction Markets in Delaware
Status: available. Last verified October 2, 2026.
Prediction markets such as Kalshi and Polymarket US are regulated federally by the Commodity Futures Trading Commission. We found no cease-and-desist letter, lawsuit or public statement from Delaware against them.
Delaware is in the Third Circuit, which ruled for Kalshi in a New Jersey case on April 6, 2026. The Sixth Circuit (Ohio and Tennessee) and Ninth Circuit (Nevada) ruled the other way, so the Supreme Court may settle the question. Third Circuit opinion
Prediction markets matter for matched betting because they do not limit winning traders. Check each app for current availability in Delaware before you deposit.

Online Casinos in Delaware
Online casinos are legal in Delaware. The Delaware Gaming Competitiveness Act of 2012 let the Delaware Lottery run internet table games and slots through the state's three casinos. Today all three run on the BetRivers platform: Delaware Park, Bally's Dover and Harrington. You must be 21 and in Delaware to play. Delaware Lottery iGaming page
Sweepstakes casinos are not licensed in Delaware. In April 2025, the Delaware Division of Gaming Enforcement ordered VGW Luckyland, which runs the LuckyLand Slots sweepstakes site, to stop serving Delaware players, calling it illegal online gaming. State announcement The Sweepstakes Casino Overview explains how they work.
Delaware Sports Betting Law and Timeline
- June 28, 2012: The Delaware Gaming Competitiveness Act of 2012 (House Bill 333) was approved. It authorized the Delaware Lottery to run internet table games and internet video lottery through the state's casinos. Session law, Chapter 285
- June 5, 2018: Full-scale sports betting launched at Delaware's three casinos, three weeks after the Supreme Court struck down the federal sports betting ban. Governor John Carney placed the first bet at Dover Downs. Delaware was the first state outside Nevada to take single-game bets. NPR report, Delaware Lottery sportsbook locations
- December 27, 2023: Mobile sports betting launched through BetRivers, run by Rush Street Interactive as the Delaware Lottery's online gaming vendor. BetRivers is the only online sportsbook in Delaware. Current sites are listed on the Delaware Lottery iGaming page. CDC Gaming report
- April 2, 2025: A cease-and-desist order from the Delaware Division of Gaming Enforcement against sweepstakes operator VGW Luckyland took effect. The state said the site violated the Delaware Constitution, the criminal code and the Gaming Competitiveness Act of 2012. State announcement
- April 6, 2026: The Third Circuit, which covers Delaware, ruled for Kalshi in KalshiEX LLC v. Flaherty, a New Jersey case, holding that federal law preempts state gaming laws for sports event contracts on CFTC-regulated exchanges. Third Circuit opinion
Offshore and unlicensed betting
No Delaware law mentions offshore or online sportsbooks by name. The general gambling law in Title 11 of the Delaware Code makes it a class A misdemeanor to keep a book or take bets on any contest of skill, speed or endurance, wherever it is held. Under 11 Del. C. § 1403, the same offense also covers a person who "directly or indirectly bets or wagers" money on such a contest. Activity in connection with a lottery under state control, which includes the Delaware sports lottery and BetRivers, is exempt under § 1413. Any other sportsbook taking Delaware bets has no legal cover, and the law's plain wording reaches the bettor too.
We found no Delaware enforcement action against a named offshore sportsbook. The Division of Gaming Enforcement has acted against unlicensed online gaming: in April 2025 it ordered sweepstakes operator VGW Luckyland to stop serving Delaware, and warned that some illegal sites copy the branding of Delaware casinos.
