Prediction Markets in Colorado
Status: available. Last verified October 2, 2026.
Prediction markets such as Kalshi and Polymarket US are regulated federally by the Commodity Futures Trading Commission. Colorado has not sent a cease-and-desist letter to Kalshi or sued it, and the Division of Gaming has said it is monitoring the court cases. CPR News report
Colorado's attorney general does oppose sports event contracts. On April 30, 2026, Phil Weiser and 41 other attorneys general told the CFTC that it lacks jurisdiction over sports-related contracts and that states should be free to regulate them. Attorney General release
Colorado is in the Tenth Circuit, which has not ruled on the question. The Sixth Circuit ruled for Ohio and Tennessee on September 25, 2026, and the Ninth Circuit ruled for Nevada, while the Third Circuit sided with Kalshi in New Jersey, so the Supreme Court may settle the issue. Sixth Circuit opinion
Prediction markets matter for matched betting because they do not limit winning traders. Check each app for current availability in Colorado before you deposit.

Online Casinos in Colorado
Online casinos are not legal in Colorado. The state's Division of Gaming says internet gambling is illegal under state and federal law, even when a site claims to be licensed somewhere else. Division of Gaming guidance
Colorado's commercial casinos in Black Hawk, Central City and Cripple Creek offer slots and table games in person only.
Colorado does not license sweepstakes casinos, so they offer fewer customer protections than state-licensed operators. The Sweepstakes Casino Overview explains how they work.

Offshore and unlicensed betting
Colorado law makes it a crime to run an unlicensed sportsbook. Under C.R.S. 44-30-1511(1)(c), it is unlawful for any person to accept a bet in any place or manner other than one authorized by a Colorado sports betting license. A violation is a class 2 misdemeanor under C.R.S. 44-30-1512. The statute does not separately mention offshore sites or advertising. In June 2024 the Division of Gaming used this position to send Bovada a cease-and-desist letter, and Bovada stopped accepting Colorado customers. Covers report
For bettors, there is no offshore-specific offence. Colorado's general gambling law makes gambling a petty offense under C.R.S. 18-10-103(1), and the definition of gambling only exempts sports betting conducted under the state's licensing law (C.R.S. 18-10-102). A bet with an unlicensed site is not exempt, but the statute does not mention online or offshore betting by name.
