Prediction Markets in California
Status: contested. Last verified October 2, 2026.
Prediction markets such as Kalshi and Polymarket US are regulated federally by the Commodity Futures Trading Commission. California has not sued Kalshi or sent it a cease-and-desist letter that we could verify. The Attorney General has instead joined multistate amicus briefs arguing that prediction markets cannot use federal law to bypass state gambling laws. Attorney General press release
On September 16, 2026, the Ninth Circuit ruled for the Blue Lake Rancheria and Chicken Ranch Rancheria tribes, holding they are likely to show that Kalshi's sports event contracts entered from tribal lands violate the Indian Gaming Regulatory Act. The ruling covers tribal lands, not the whole state, and the case returns to the district court. Read the opinion
Prediction markets matter for matched betting because they do not limit winning traders. Check each app for current availability in California before you deposit.

Online Casinos in California
Online casinos are not legal in California. Casino gaming is offered in person only, at tribal casinos and licensed cardrooms.
Sweepstakes casinos are also banned. Governor Gavin Newsom signed Assembly Bill 831 on October 11, 2025, making it unlawful to operate or promote online sweepstakes games that use a dual-currency system. The ban took effect January 1, 2026, and also covers payment processors, geolocation providers and media affiliates that knowingly support these sites. Offshore and unlicensed betting
California has no law aimed specifically at offshore sportsbooks. Its general sports betting ban, Penal Code section 337a, makes it a crime to make, offer or accept a bet on the result of a contest. In Opinion 23-1001 (July 3, 2025), the Attorney General concluded this applies to players physically in California regardless of where the operator and its technology are located, and that a person in California "would violate section 337a by placing bets over the Internet" on daily fantasy sports. Attorney General opinion
We found no published California enforcement action, such as a cease-and-desist letter or blocking order, against a named offshore sportsbook.
