Prediction Markets in Arkansas
Status: contested. Last verified October 2, 2026.
Prediction markets such as Kalshi and Polymarket US are regulated federally by the Commodity Futures Trading Commission. On October 23, 2025, Arkansas Attorney General Tim Griffin issued a formal opinion, requested by Senator Bryan King, concluding that a company like Kalshi offering sports event contracts without a state gaming licence would be operating illegal gambling under Arkansas law. Read the opinion
An attorney general opinion is not a court ruling or an enforcement order. We found no cease-and-desist letter or lawsuit by Arkansas against a prediction market as of October 2, 2026. Elsewhere, the Sixth Circuit (Ohio and Tennessee) and the Ninth Circuit (Nevada) have ruled for the states, while the Third Circuit sided with Kalshi in New Jersey, so the Supreme Court may settle the question.
Prediction markets matter for matched betting because they do not limit winning traders. Check each app for current availability in Arkansas before you deposit.
