Prediction Markets in Arizona
Status: contested. Last verified October 2, 2026.
Prediction markets such as Kalshi and Polymarket US are regulated federally by the Commodity Futures Trading Commission. Arizona treats sports and election event contracts as illegal gambling. The Department of Gaming sent Kalshi a cease-and-desist letter in May 2025, and on March 17, 2026, Attorney General Kris Mayes filed 20 criminal counts against Kalshi. Attorney General announcement
On May 5, 2026, a federal judge in Arizona blocked the state from enforcing its gambling laws against Kalshi while the case continues. On August 28, 2026, the Ninth Circuit, which covers Arizona, ruled for Nevada in a similar case, holding that sports event contracts are likely not swaps. Arizona has asked the Ninth Circuit to lift its injunction, and Kalshi has asked for a rehearing of the Nevada ruling. The Third Circuit sided with Kalshi in New Jersey and the Sixth Circuit sided with Ohio and Tennessee, so the Supreme Court may settle the question. Read the Ninth Circuit opinion
Prediction markets matter for matched betting because they do not limit winning traders. Check each app for current availability in Arizona before you deposit.

Offshore and unlicensed betting
Arizona law requires a license for any event wagering offered in the state. Section 5-1303 says a person may not offer any activity in connection with event wagering in Arizona without the required licenses. A.R.S. 5-1303 Running an unlicensed betting business is a crime: promotion of gambling is a class 5 felony, and accepting bets as a business is a class 1 misdemeanor. A.R.S. 13-3303, A.R.S. 13-3305 The Department of Gaming has used these laws against named offshore books, including Bovada in 2024 and MyBookie and BetUS in 2025. Bovada release, April 2025 release
No Arizona statute mentions offshore or online betting by players. The criminal code makes it a class 1 misdemeanor to knowingly obtain any benefit from gambling, unless it is amusement or regulated gambling. Bets with a state-licensed sportsbook count as regulated gambling; bets with an unlicensed site do not. This is a general gambling rule, not one written for online or offshore betting. A.R.S. 13-3304, A.R.S. 13-3301
